As previously outlined, if your complaint relates to an allegation that an officer has, or may have, committed an act or omission that infers criminal conduct, the matter must be referred to the Area Procurator Fiscal who is wholly independent of the police service. Complaints alleging misconduct If the person who lodged the complaint is not satisfied as to the outcome of the investigation undertaken by the police into their complaint they may refer the matter to the Police Complaints Commissioner for Scotland (PCCS) and request that they conduct a Complaint Handling Review of the manner in which the complaint was dealt with by the Force.
